1. Our Contract

 

These Terms and Conditions govern the supply of goods sold by Freeform Varifocals Limited (referred to as “we” and “us”) of Freeform House, 69, Seaview Road, Wallasey, Wirral, CH45 4QW through our website – www.freeformvarifocals.co.uk.

 

Freeform Varifocals Limited is registered in ‘England & Wales’, company number 6260536.  This contract is subject to and governed by United Kingdom Law.

 

These Terms & Conditions in combination with the order form constitute the complete agreement between the customer and us.  Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us, on these terms and conditions.

 

2. Conditions of Sale

 

Customers must be over 16 (sixteen) years of age and not be registered blind or partially sighted.

 

Your prescription must have been issued within the last 2 (two) years.  If requested, a copy of your prescription must be submitted to us.

 

3. Price & Payment

 

(a)    The price payable for the goods you order is as set out on our website at the time you place your order.

 

(b)   We must receive payment in full for the whole of the price of the goods you order before your order can be accepted.

 

4. Delivery Schedule & Title

 

We will process your order right away.  We will normally send your choice of frame/s to you within 2 - 3 business days.  However, please allow up to 20 working days for your completed order, as certain combinations of lenses, particularly some combinations of varifocal, high index or transitions (react to light) lenses and coatings can take extra time.  We will try and despatch them sooner if we can!  For orders outside the UK please allow about 5 working days more for delivery.  Goods will be delivered in accordance with your order.  A valid signature will be required on receipt of goods.  Immediately after signing for delivery, title in the goods will pass to you.  In the unlikely event that you have not received all the goods within 7 days of despatch, you must notify us immediately.

 

5. Availability

 

Whilst we endeavour to carry sufficient stock to meet all orders, on the rare occasion where we have insufficient stock to supply the goods ordered and paid for by you, we will refund back to the original credit/debit card used in payment.

 

6. Cancellation & Returns

 

(a)    You have the right to cancel an order within 10 (ten) days of the date of delivery.  Such notice may be given by e-mailing, faxing or mailing to the number or address listed on the order form.  If you are cancelling due to a problem with the goods, please inform us of the problem at the time of cancellation.

 

(b)   We will refund the full cost of the frame on receipt of the goods, returned in a satisfactory condition.

 

(c)    We can only refund 50% of the cost of the lenses, as they are customised items.

 

(d)   You must return the goods to us at your cost unless the goods are being returned because they are faulty or incorrect goods, in which case we will meet the cost of the return but we ask that you allow us to nominate the carrier.

 

(e)    The cost of carriage and insurance is non-refundable.

 

7. Liability

 

(a)    If you have notified us of a problem with the goods, we will replace or repair any goods that are damaged or defective upon delivery, or refund to you the amount paid by you for the goods in question.

 

We will not be liable to you for any administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.  This does not affect your statutory rights as a consumer.

 

(b)   We shall not be liable for any errors and omissions made by you when entering prescription details online.

 

(c)    Freeform Varifocals Limited is registered in England and Wales and subject to United Kingdom Law.  We make no legal provision for other countries; therefore, customers outside the UK take full and sole responsibility for compliance with the law in their own country.

 

8. Force Majeure

 

We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

 

9. General

 

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected.  This contract shall be governed by and interpreted in accordance with United Kingdom Law.

 

10. VAT

 

All prices include VAT at 17.5%.

 

11. Accessories

 

All frames come with one appropriate case and lens cloth.  Case images (if shown) are examples only and do not necessarily represent the exact case supplied.

 

12. Design, Images and Reproduction

 

Whilst maximum care is taken during the photography and editing of the frame images, the actual colour may differ slightly from that shown, due to variations in monitor/LCD characteristics.  Logos on the lenses (if shown) are on the dummy lenses only and won’t appear on the completed spectacles.

 

Images, code, layout and style are all copyright.  Reproduction in whole, or in part is strictly prohibited without written permission.

 

13. Making A Purchase

 

Making a purchase could not be easier.  Simply browse through our range, select your frame and lens options, enter the required prescription information, then add your glasses to the shopping cart.

 

Note:   For accuracy purposes, we require a duplicate/original copy of your prescription, to be included in the package when you return your choice of frames to be glazed.  This will be returned to you along with the completed order.  Alternatively, you may wish to scan your prescription details through to us instead.

 

After you have finished your selection, click on “CHECKOUT” and you will be asked for a few details that we need to be able to satisfy the order.

 

We accept credit/debit card payment.  We accept Visa, Mastercard, Switch, Solo and Maestro.  You may send your credit card information over the Internet using our fully encrypted site.  If you prefer, you can send a cheque made payable to Freeform Varifocals Limited, by post and your order will be processed on receipt.  When credit/debit card orders are processed the name appearing on your slip and statement is Freeform Varifocals Limited.

 

14. Credit Card Security

 

Our sites use 128 bit encryption – which is very safe.  We know of no documented cases of credit card fraud using our shopping system over the Internet.  All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption.  They are only decrypted after they reach our computer.  They are not held in any clear text on any website.  We have chosen HSBC due to it having formidable security with regard to its card processing facility.
